Mr. Bates opened the meeting at 7:40 PM. 

 VARIANCE
Thomas J. Converse of 463 High Street is in the process of selling his house and requesting a variance on the Board of Health’s septic regulations requiring a hookup to town sewer when a property is being transferred.  Motion was made by Don Bates to approve the variance for Tom Converse pending whether it is necessary to hold a public hearing before granting the variance

HICKORY WOODS—DRAINAGE
The Board received a letter from Fred Bottomley addressing his concerns with the subsurface drains in Hickory Woods Estates.
The scope of how many homes that are affected by the subsurface pipes that drain off from the properties of some residential homes is unknown. The need for Board of Health action at this time is also unknown.  Some of the drain pipes appear to be too close to the septic systems and may violate Title V.

NORTH ATTLEBORO BOARD OF HEALTH

October 24, 2006 at 7:00 pm

Visitors:  Dr. Daniel Brown, Interim Physician; Gregory Bunavicz, Engineer; Tom Converse of 463 High Street

Mr. Bates opened the meeting at 7:01 P.M.

PHYSICIAN
The Interim Town Physician, Dr. Daniel Brown, introduced himself to the Board members. Dr. Brown is willing to administer vaccines, distribute educational material and conduct informational seminars. Don Bates would like Dr. Brown to visit the Board again.

463 HIGH STREET
Tom Converse is selling his house at 463 High Street which has a septic system and town sewer does run in front of his house. Mr. Converse is looking for relief from the town’s mandate which states, before the transfer of ownership the owner must tie into the town sewer. The property had a passing Title V inspection in June 2006. Don Bates stated that Mr. Converse must submit a letter to the Board requesting a variance. The Board will take the variance under advisement and vote at their next meeting.

BORDERLAND ENGINEERING, INC.
Gregory Bunavicz presented a proposal to the Board for engineering consultant services including Title V design review and soil evaluation/percolation testing witnessing.  Don Bates stated that the Board would be interested in having an engineer available for large subdivision projects to perform perc testing and plan review.  Don Bates would like Mr. Bunavicz to sign an agreement of general terms.

LETTERS
The Board asked the secretary to send thank you letters to Dr. Brown and to Greg Bunavicz for attending tonight’s meeting and for presenting their services to the Board. The Board will discuss their needs and will be in touch with them. The Board wants Dr. Brown to know that they will be appointing a permanent physician soon and would like to know if he would consider the permanent position.

The Board received a letter from the Planning Board on the modification of Hickory Woods subdivision plan. MT. HOPE FARM ESTATES
The Board received a letter from the Planning Board regarding the preliminary subdivision plan.

STORM DRAIN MARKETING KIT
The Board received an email from Michael Stankovich on the storm water year 4 product notice. The product would be purchased by the DPW if it were to be purchased.

MHOA
A letter was received from the new Tobacco Control Director, Sarah McColgan for the Mass. Health Officers Association. Diane Battistello would like to inquirer about mini grants through the program. Don Bates will call Sarah McColgan.

DISPOSAL WORKS INSTALLER EXAM
Motion made by Diane Battistello to have the office staff administer the DWI exam to any new applicant.

BOARD OF HEALTH PENALTY AND FINES
The Town By-Law articles for Board of Health Penalty & Fines will be discussed at the next Board meeting.

SECURITY DOOR
Don Bates has not received a quote for the security door from Michele Bernier.  Don Bates read comments from Anne Marie Fleming regarding the advantages and the disadvantages for moving the Board of Health offices to the vacant Park Department on the main level of the Town Hall.

MASSAGE ESTABLISHMENT
A woman came to see the Health Agent about the requirements for licensing of a massage establishment which states that you would have to be connected to the town’s sewer system and she has a septic system.  Diane Battistello will do some research on massage regulations.

b.                  A letter was received from Gay, Gay & Field, R.C. addressed to Attorney Robert Bliss on a pretrial conference date for Battistello et al v. Stankovich et al on the fluoride issue. Don Bates stated for the record that Battistello et al does not include Don Bates.

c.                   A letter from Susan Shaw to Conservation Commission on a request for the order of conditions regarding Christina Estate.

Vouchers

The members reviewed vouchers for mileage and toner for the printer. Don Bates signed the vouchers.

Don Bates signed the September bill for Attorney Paul Mulkern.

Town By-Law Articles for Board of Health Penalty & Fines

Don Bates asked that the members review the By-Law articles.

Hirsch Farm

Mr. Stankovich, Director of the Dept. of Public Works suggested that the Board be prepared to make comments to the Planning Board on the Depot Street project and the Water Aquifer Protection area.

Cameron Woods

The Board reviewed the three lots that will have septic systems which include lots 4, 5 and 6 on the definitive subdivision plan for Cameron Woods.

Complaints

a.         967 Longview Drive—the trash in the yard will be addressed in a letter to the homeowner.

b.         Diane Battistello will review the complaint log and let Don Bates know what complaints are left to resolve.

Requests of records
Don Bates has been in contact with Rebecca Murray from the Secretary of State’s office on requests for public records.  Diane Battistello stated that Mrs. Drown had never made a request for the emails that John Leite had requested from the Board and Don Bates agreed.

Borderland Engineering, Inc.
Don Bates met Engineer, Gregory Bunavicz  in the Board of Health office who was looking for business. Diane Battistello wants to interview Mr. Bunavicz at the next board meeting. The secretary will contact Mr. Bunavicz and have him bring copies of his licenses to the meeting.

Revolving Fund
The Board does not have a revolving fund established for the employment of outside consultants to review subdivision plans under Chapter 44: Section 53G.  The secretary will contact the Town Planner for their article on the Planning Board’s revolving fund.

Interviews
The members will provide a list of requirements for the Health Agent candidates during the interview process.

MuniTrack
Anne Marie Fleming received an invoice for the annual maintenance program for $1,125.00 for the office mobile module.  The MAHB was in charge of the original billing and contract with Coler & Colantonio and the office should not have received this bill.

I.    Mr. Bates opened the meeting at 6:40 p.m.

II.     Town Physician:

      Ms. Fleming asked the Board to consider taking the agenda item of appointing a new town       physician, to replace retiring Dr. Gutman, out of order. 

        Motion: Don Bates moved to approve Dr. Brown as interim Board of Health physician to such                     time as the Board hires a permanent replacement.

        Second: Ms.  Battistello                                     Vote 3 – 0, motion passed

III. Minutes

    A.    Motion: Mr. Bates motioned to approve the minutes of: July 6, July 10, July 31, August 8, August     14, and August 29.

IV. Public Comment

Mrs. Drown asked for an explanation on why her letter regarding the removal of a public record from the Board of Health office had not been answered.  Mr. Bates will contact the Secretary of      State’s office regarding the matter.

VI.           Letter to Rocky Mountain Spring Water  

         Motion: Mr. Bates motioned to send a letter written by Ms. Battistello to Rocky Mountain Spring       water regarding the maintenance of the machines in front of Benny’s.

VII.            Gloves and Food Handling at Emerald Square Mall

            The state law allows people to handle food for demonstration purposes without the use of gloves,              as long as the food handler uses a utensil to touch the food (i.e. – a serving spoon or toothpick).

            Mr. Casper will ask the demonstrators to use gloves in the future.

VIII. Cobblestone

            A. Mr. Ottenheimer advised the Board to move forward with the Cobblestone project but to add a                    list of conditions to address outstanding concerns.

            B. Motion: Mr. Bates motioned: Pursuant to Massachusetts General Laws Chapter 41, section 81U, the North Attleborough Board of Health has reviewed the proposed subdivision known as Cobblestone located on Plat 22 Lots 43 and 44 and Plat 26 Lot 11 based on a design by Leonard Bradley, P.E., DiPrete Engineering Associates, Inc. dated February, 2006, revised April 4, 2006,  and May 5, 2006.  Based upon review of the most recent submission, the North Attleborough Board of Health votes to recommend Approval of said plan with the exception of the parcels numbered 34, 43, 44 & 45 as they have not demonstrated their suitability for providing for an on-site wastewater system. 

                The approval is provided with the following conditions:

1.              The erosion control measures proposed for during the construction phase of the common             ways and common utilities are to be built and maintained by the owner with oversight             provided by the Planning Board and/or Board of Health.

2.                  The storm water collection, treatment and dispersal systems are to be constructed by the             owner with oversight provided by the Planning Board and/or Board of Health.

3.                  A homeowners association (“Association”) is to be created and funded by the owner prior             to the sale of any lot to a home owner, and the approval of any building permit.  The   Association is to be responsible for all drainage system maintenance and repairs including road sweeping, catch basin cleaning, and storm water treatment system management, and, other requirements as indicated on Detail Sheet 1 of the subdivision plan (“Plan”) and in the document titled “Soil Erosion and Sediment Control Measures/Sequence and Staging of Land Disturbing Activities” (“Document”) most recently revised July 20, 2006.  The scope of responsibilities for the Association regarding the drainage and storm water systems may only be amended or reduced upon written concurrence of the Town Planning Board and Public Works Department.  The requirement for creation of an Association supersedes the language on the Plan and in the Document which indicates private parties or the Town of North Attleborough is to perform these services.

4.                  The Planning Board is encouraged to review the proposed storm water basins with             considerable scrutiny.  Concerns about the long-term ability to reduce the water table beneath the basins are prevalent.  If the basins do not function as designed it is possible that mosquito breeding habitat will be created and/or the possibility for ground water or surface water contamination is increased.

5.                  Prior to the Board of Health’s approval of any application for a building permit on a             particular lot, adequate test pits are provided on each parcel to assure compliance with Title 5 of the Massachusetts Environmental Code and suitability for an on-site wastewater treatment and dispersal system.

6.                  The document titled “Soil Erosion and Sediment Control Measures/Sequence and Staging             of Land Disturbing Activities” (“Document”) most recently revised July 20, 2006 is to be             printed on and made a part of each individual Title V septic design plan approved by the Board of Health, and evidence of the receipt of the Document by the original builder for each lot satisfactory to the Board of Health is provided to the Board of Health. 

7.                  The project is traversed by a tributary which leads to a public water supply reservoir             servicing the Town of Attleborough.  Concerns or comments from the Attleborough Planning Board, Board of Health and/or Water Department should be sought prior to approval.

8.                  The Board will reconsider it’s denial of approval of lot 34 upon demonstration of the lot’s             compliance with Title V at any time prior to the Planning Boards final action of the             subdivision plan.

IX. Subdivision Concerns for Future Projects.    

A.     Revolving Fund for Sub-development  Engineering Fees:   The Board will have to start again on this issue and petition RTM to establish a revolving account for the purpose of handling money between the sub-developer and the Board’s consulting engineer.  The Accounting office had mistakenly advised the Board that such an account was already established.

B.     Home Owner’s Associations:  The Board of Health will extend an invitation to the Planning Board, the Department of Public Works, and the Conservation Commission to meet in a workshop for the purpose of establishing a comprehensive maintenance policy for sub-division detention ponds and catch basins.

X.     Interviews for Health Agent

The Board members will start reviewing the resumes of applicants for the Health Agent position.  Mr. Bates will talk with Human Resources about the interviewing process.  The estimated date for the first interview to begin is October 17.

Health Agent Report
Mr. Casper and the Board discussed several topics of the August report:

Cameron Woods: Rob witnessed 6 perc tests at 3 lots.  The developer, Mr. Tilton, hopes to sewer the whole development, but lots: 5, 6 & 7, are proposed for on-site septic systems for present time.  The Board is concerned about the drainage because the slope goes into Kelley Blvd.

Diamond Street Complaint: Mr. Masterson  (#11 Diamond Street) is concerned about septic leakage flowing onto his property from #9. Mr. Masterson and Health Agent Casper will walk the property during next rain.

Health Agent Daily Log: Mr. Casper explained to the Board his system for compiling his Health Agent Daily Log.

Cushman Road Estates:  Mr. Casper described what appears to be the beginning of a 12 lot subdivision.  Mr. Tilton needs 4 days for perc testing. Mr. Casper’s time, as interim agent, is stretched in a way that he does not have 4 consecutive days to witness the tests.  The Board discussed having Mill River Consultants witness the perc tests and conduct the soil evaluations.

Motion: Mr. Bates moved to engage Mill River Consulting to do the perc tests and soil evaluations for 12 lots at Cushman Estates, provided Mill River’s fees match the current Board’s schedule.

Nail Salon Regulations:  Mr. Bates will ask Ms. Vandette to forward the Nail Salon Regulations to Mr. Bliss, Town Counsel.

48 Leonard Street –  Pigeons: Mr. Casper visited the residence and noted that the pigeon coop had been moved out of sight.  Ms. Battistello noted she had talked with Ms. Maedernach and that things were better since the cage was moved out of sight.

Laptop:  Ms. Battistello will talk with Nurse Fleming about the MAHB software that the coalition  purchased for our laptop computer.

Inventory:  The Board will do an inventory of the offices in the near future.

New Business:

Mount Hope Farms Estates:  The Board reviewed a preliminary subdivision plan for Mount Hope Farm Estates at 193 Mount Hope Street.

Animal Control:  Mr. Bates will ask Zoning Board of Appeals for a copy of their regulations so the Board can determine the current status of animal restrictions.

Wood Fire Boilers: Mr. Bates initiated a discussion about wood fire boilers as an alternative energy source.  Mr. Casper noted many people burn treated wood in these, causing a pollution problem.  Mr. Bates will continue to monitor the news on this topic so that the Board can be prepared.

Labor Attorney Fees:  The Board reviewed the schedule sent by Labor Counsel Mulkern.
Union Hearing: The Board noted they will attend Mr. Drown’s Union Hearing tomorrow.

 Vouchers:  The Board reviewed August vouchers.

Rob Casper will check the property to see if the pigeon loft has been relocated. Don Bates will email a draft letter to the secretary to be sent to Susan Stocks.

ANIMAL CONTROL REGULATIONS

Diane Battistello wants the Board to consider drafting regulations on chickens and pigeons.

LAPTOP
Rob Casper informed the Board that he has been using the office laptop to type up his reports. Rob will speak with Keith/MIS Dept. to have Keith checkout the laptop for security software.

COMPLAINTS

CINEMA PUB/dumpster overflowing
Rob Casper will check to see if the Cinema Pub ever got a newer dumpster.

EMERALD SQUARE MALL/leaking dumpster
Rob advised the Board that he had spoken to Don Anderson, maintenance for the Mall on last Friday. Mr. Anderson will have a drainage trench put in place across the apron of the area where the dumpster is housed so that the leakage doesn’t run into the parking lot.

LENS CRAFTERS/doctor with blood on his hand
When Anne Marie took the complaint she gave the phone number for the Mass. Board of licensing optometrist to do an investigation. 

145 BROAD STREET/leak & mold
The Building Department wrote up a report on the leak and mold issue which the secretary will request from the Building Inspector.

160 CHARLES STREET/rubbish
Don Bates will investigate the rubbish and old mobile home on the property.

9 DIAMOND STREET/septic overflowing  
Rob Casper will investigate the septic system overflowing.

27 LAKESHORE DRIVE/mold
Rob Casper presented pictures and had suggested to the tenant and the management to have a certified mold inspector investigate.

84 LEONARD STREET/housing
Rob Casper will investigate the housing issues.

965 LONGVIEW DRIVE/trash
Susan Shaw investigated and found trash on the property. Susan will send a letter to the homeowner to clean up the trash.

130 NORTH WASHINGTON STREET/dumpster overflowing

INVENTORY
Don Bates suggested that the office staff do an inventory of the equipment in the office especially the equipment in the tobacco cessation cabinet.

CUSHMAN ROAD PLANS
The Board reviewed the Cushman Road preliminary plan and Susan Shaw said that only one house was build. 

DPW/engineer
Susan Shaw spoke with Bob Norton about the hiring of an engineer for the town and he suggested that the Board submit an article for Town Meeting. Don Bates stated that it is a good idea but he thinks it is premature at this time.

HIRSCH FARM DEVELOPMENT
Susan Shaw would like the Board to review the plans again. She thinks that the engineer from Mill River Consulting should do the perc tests in Hirsch Farm development. 

HICKORY WOODS/perc test and soil evaluation
Rob Casper stated that in Hickory Woods subdivision all the soils are class one and class two which is sand and loamy sand.
The Board will meet with other Boards and the Selectmen to discuss the issue of drainage in Hickory Woods.

OFFICE COVERAGE
The Board will take notes and run the tape recorder for the secretary for the September 11th and September 25th Board meetings due to her covering the office during the day with the clerk and the nurse at computer classes those days.

Meeting Minutes of
August 14, 2006, 6:30 p.m.

1.      In Attendance: Donald Bates, Chairman; Susan Shaw, Member, Diane Battistello, Member, Amy DeMelia

2.      Mr. Bates opened the meeting at 6:30.

3.      Assistant Health Agent Performance: Mr.  Bates initiated a discussion regarding the duties and available hours of the Assistant Health Agent during the current staffing shortage.  Assistant health agent, Rob Casper, works between 15 and 20 hours a week and he is available for Board meetings on both Monday and Tuesday evenings.  Mr. Casper witnesses perc tests, reviews septic plans, and performs inspections.  As yet, the Board has not asked Mr. Casper to keep a daily work log.  Mr. Casper’s production can be measured by his monthly report.

4.      Budget: At present the department is duplicating salaries for the health agent position as Mr. Drown was paid for 5 weeks of vacation time.  At year end the department’s records may show that the pay out was more than what is in the budget.  The Board may have to request additional funds.

5.      Job Sharing Engineering Services: Ms. Shaw will verify if the DPW is intending to hire an engineer and she will ask about the possibility of sharing the job with the Board of Health.

6.      Advice on Hiring a Health Agent: Mr. Bates will talk with Dan Ottenheimer of Mill River Consulting regarding what others towns consider when they are hiring a health agent.

7.      Motion to Appoint Interim Health Agent, Vote:
Ms. Battistello motioned to appoint Rob Casper Interim Health Agent, at the base rate of $27.82 for 15 – 20 hours.  Ms Shaw seconded the motion.                                                 Vote 3-0, Unanimous 

8.      Motion to Assign Terms and Performance Conditions to Interim Health Agent, Vote:
Ms. Battistello motioned that the terms and performance of the interim health agent be reviewed quarterly, and last no longer than the point in time in which the Board of Health appoints a full time health agent.  Ms. Shaw seconded the motion.                                                                         Vote 3-0, Unanimous

Marty Zailskas has a noise issue with a neighbor who lives across the street. She has spoken to the landlord about the tenant’s loud music but it didn’t make a difference.
Don Bates suggested that she call the Board of Health office the next time there is loud music. There is a decimal meter in the office to measure noise

COMPLAINT/145 BROAD STREET
It was suggested that a letter could be sent to the owner of 145 Broad Street giving him two weeks to fix the mold problem.

COMPLAINT/CINEMA PUB
The office hasn’t heard from Chris Ballarino on whether he has upgraded the dumpster for Cinema Pub yet.

COMPLAINT/48 DEPOT STREET
Susan Shaw investigated the smell complaint at 48 Depot Street and found the stables to be very clean and there was no odor. At the present time their stable license is overdue and the owner will be contacted.

COMPLAINT/BESIDE 610 HICKORY ROAD
Susan Shaw investigated and found construction debris next to 610 Hickory Road. Ms. Shaw will contact Dale Langille and tell him when she went to check the property.

COMPLAINT/HILLVIEW TERRACE
The overflowing dumpster on Park Street is being monitored by the Board. Don Bates took a picture of the dumpster this week and Diane Battistello will view the dumpster next Monday.

COMPLAINT/27 LAKESHORE DRIVE
Diane Battistello left a message for the Assistant Health Agent, Rob Casper to meet with the landlord to check out the mold issue at 27 Lakeshore Drive.

COMPLAINT/25 WEST BULFINCH STREET
Diane Battistello spoke with someone from Franklin Square Management and will have them speak to the parties involved on the trash complaint at 25 West Bulfinch Street. 

NEW BUSINESS/ HEALTH AGENT POSITION
Diane Battistello stated that there is no mention in the job description that the Health Agent witnesses perc tests. Therefore, the Board could hire an outside party for perc testing. John Lavin charges $120.00 an hour for witnessing perc tests which would fall under the perc test fees. Diane Battistello will speak to the accountant’s department to learn the process for setting up a revolving fund so that the Board could write the checks for payment. This would free up the Health Agent to do the administrative duties of the office.

Susan Shaw stated that the Department of Public Works will be hiring their own engineer and that person would be available to other Boards. Diane Battistello would like to see the perc test season for the town to be changed to October through June and not year round as it is now.

Don Bates motioned to appoint Rob Casper as the interim Health Agent at the hourly rate of $27.82 for 15-20 hours a week until such time of hiring a full time Health Agent.

Diane Battistello would agree to giving him a raise but not the title because she doesn’t know anything about him and hasn’t seen his resume in a while. Diane Battistello would rather see Rob Casper’s position stay as the Assistant Health Agent.

Susan Shaw would like to consult with Town Counsel.

Don Bates stated that Catherine Calicchia, Director of Human Resources will draft a letter which the Board would like to review and approve the letter before the letter is presented to Rob Casper.
Don Bates said the letter will state that Rob Casper is hired as the interim Health Agent at the rate of $27.82 an hour.
Don Bates modified the motion that based upon the Board’s review and acceptance of the drafted letter written by the Human Resource Director that the Board will appoint Rob Casper as the interim Health Agent at the hourly rate of $27.82 for 15-20 hours a week until such time of hiring a full time Health Agent
The Board will review the draft letter from the Human Resource Director on August 14th at 6:30 PM and take a vote to hire Rob Casper as the interim Health Agent.

REQUEST OF PUBLIC RECORDS
Mary Lou Drown had made a request for copies of letters that the Board would have received from Town Counsel, Robert Bliss and the Town’s Labor Attorney, Paul Mulkern. She should have received a letter from the Board stating what the cost would be to obtain the copies. Don Bates stated that he instructed the secretary to give Mary Lou copies of Robert Bliss’s letters that the office had at no cost to her. Mary Lou was offered the copies at the meeting but would not accept them because the Board had not charged her a fee and it had been over the ten day limit. She will call the Secretary of State’s office on this matter.
Back in April, Mary Lou had requested copies of emails in reference to the truck policy. All Mary Lou received is a copy of the minutes in reference to the truck policy.  

PIGEONS
Motion made by Don Bates to send a letter to Susan Stocks requesting the cope to be moved to a more central location out of site from the neighbors within 14 days and away from the property line.

CINEMA PUB
Chris representing Cinema Pub told the Board that other people are using their dumpster and that is why there is an overflow of trash. It was suggested that Chris obtain a new style dumpster within 30 days that could have a chain and padlock put on. Chris will provide a picture of the new dumpster to the office. The secretary will notify the Board on August 24th if the office does not hear from Cinema Pub so the Board can take action.

NAIL REGULATIONS
Ms. Battistello will send a copy of the drafted Nail Regulations to Town Counsel for his review.

MINUTES ON THE WEB
The Board wants to know how long it takes Celeste to put a set of minutes on the website. The Board wants the current minutes from July then going backwards.

COMPLAINT/HILLSIDE TERRACE
The office received a complaint of overflowing trash at 223 Park Street. The maintenance engineer, Jeff Pierce said that three apartments had vacated within the last six weeks creating more trash. The members will monitor the trash bin on Monday mornings for three weeks.

COMPLAINT/LAKESHORE DRIVE
Mr. Kingsly is a tenant of a basement apartment and is complaining about mold in his apartment. Rob will call the landlord and have him address the mold in the apartment.

PRELIMINARY SUBDIVISION PLAN
The Board reviewed the Hirsch Farm preliminary subdivision plan. Susan Shaw will check with the Conservation Agent because she has concerns with the proximity of the reservoir and the aquifer area of this subdivision.

HEALTH AGENT POSITION
The Board wants the advertisement for the Health Agent’s position to be posted on the Mass. Health Officers Associations website besides advertising in the newspapers.
In the meantime, Rob Casper is covering the Health Agent’s job on Tuesday afternoons, every Wednesday and every other Friday. 

HEALTH AGENT POSITION-- CONTINUED
Susan Shaw would like the Board to change the job description for the Health Agent’s position to include engineer work to the job posting. Don Bates told the members that you are dealing with an ATP unionized position and you can’t arbitrarily change the job description unless you go to the union to request a change.

Diane Battistello was interested in hiring an independent engineer to do perc testing. She has done some inquiries with other towns on fees for perc testing.

COMPLAINT/NEXT TO 610 HICKORY ROAD
The office received a complaint today on an old barn that was torn down and the debris was left on the property next door to 610 Hickory Road. Susan Shaw will investigate.

PHOTO ID
Don Bates mentioned that the members should have photo ID’s when they go out on complaint calls and Don Bates will inquire with some town departments. 

SELECTMEN’S MEETING/PIGEONS
Don Bates will write a letter to Susan Stocks requesting her to move the pigeon cage and a copy of the letter will go to the Selectmen.

ASSISTANT HEALTH AGENT
Rob Casper, the town’s Assistant Health Agent has been reappointed for another year and came in to reacquaint himself with the Board. Rob stated that summertime is busy for inspections with the addition of swimming pools to inspect. 

PIGEON LOFT AT 83 LEONARD STREET
The neighbor, Sheila Maedernach is concerned with the feces that is on the grass under the cage and also wants the pigeon cage moved.
Diane Battistello will speak with the owner, Sue Stocks and suggest that she move the pigeons to WWI Memorial Park and for her to run a program to teach residents of how to care for home pigeons. Sue will have until August 1st to move the pigeon loft. Karl will speak to a State Veterinarian on animal health.

NAIL REGULATIONS

GLOVE REQUIRMENTS FOR FOOD HANDLING
Demonstrators need to wear gloves that are serving food to the public. Diane Battistello inquired if the Board made a regulation for demos, how would it affect a waitress? Karl stated that you need to be specific on the regulation. Karl will write a draft regulation and email the members by the end of the week.

POLICY ON DOUBLE SIDED PHOTOCOPIES
The Board wants the agenda double sided. Karl informed the members that sometimes the automatic feeder gets jammed on the copy machine but we can try to double side the paperwork. 

COSMETIC LASER PROCEDURES
There are two businesses in town located on Orne Street that use cosmetic lasers. Diane Battistello is concerned with how well trained the person is that does cosmetic laser procedure.

GENERAL LEDGER
Diane Battistello requested a copy of June’s general ledger of the recorded vouchers.

EMAILS
Don Bates stated that members have a right to come into the office and make a request of any paperwork and that Karl acted inappropriately with Diane and it is something that should not be repeated.

Mr. Drown completed his presentation by commenting on his achievements on his goals regarding: septic permitting, Chauncey Estates subdivision, computer training, the health agent’s monthly report, subdivision notification, permits and license fees, nail regulations, budget practices, budget and town meeting articles, time spent assisting other departments and the community, and the town truck. The Board questioned Mr. Drown and asked for clarity on several occasions.

Mr. Bates asked the Board to revisit the issue of the Town truck.

PIGEON COMPLAINT

Sheila Medernach living at 91 Leonard Street, came before the Board with her complaint of pigeons being housed at 83 Leonard Street by homeowner, Susan Stocks. Sheila submitted an action needed report on June 8th complaining of the odor and the location of where the pigeons are housed.

A)                Health Agent will visit the site to check for odor

B)                 Karl will speak with the Building Inspector regarding zoning regulations

There was much discussion on who would have the authority to maintain the detention ponds and drainage on private property.
Copies of the changes on the Cobblestone Estates plans and the recommendations from Dan Ottenheimer, engineer for Mill River Consulting will be forwarded to the Department of Public Works.

The Board will have a public hearing on the Nail Salon regulations possibly on Tuesday, August 8, 2006.

Don Bates stated that the Board will have a public hearing to discuss the use of lasers in North Attleboro. Diane Battistello has concerns about the safety of using lasers. Town Counsel has received the letter but has not answered it.

The members had just been informed that the Planning Board was in session with a public hearing on Christina Estates.

Diane Battistello motioned for the Board to write a letter to the Planning Board informing them that the Board of Health is still waiting for comments from Town Counsel. Diane Battistello will excuse herself from the Board of Health meeting to deliver the letter to the Planning Board at their meeting being held at the Police Department

Dan Ottenheimer of Mill River Consulting came before the Board for review of his comments and to hear DiPrete Engineering’s response.
      1.                  emergency shut off from detention ponds a shut off valve will be placed in a manhole so that a spill would be contained in the basin
      2.         stormwater systems in sensitive areas such as water supply each basin will have one inch of storage volume for water quality
      3.         snow removal in the subdivision snow will be plow to the side of the road and stockpiled at the end of the cul-de-sac
      4      concern with stagnant water at the detention basin Subdrains would be placed to dry out the basins  
      5.      Diane Battistello requested that Dan Ottenheimer witness the soil evaluation and the deep hole tests in the areas that are questionable due to the high water table.
      6.         Section 6 needs to be rewritten to tighten up the language
      7.         The property owner will be responsible for any maintenance during the construction Period.
      8.         There needs to be a maintenance plan for the retention ponds.

CONTRACT HOURS
Karl Drown and Anne Marie Fleming will need to request vacation time in writing, giving a two week notice, accept for emergency situations. Don Bates and Diane Battistello had reviewed this matter with Karl Drown. The Board establishes Karl’s work hours and he does not have the flexibility to change his work hours without notifying the Board.

FLUORIDE
Diane Battistello wants the Board to vote again on removing fluoride from the town’s water supply.

Diane Battistello motioned to reaffirm the Board’s position to remove fluoride from the water supply as soon as possible.

  3. In regards to the Human Resource letter delivered to her home in Rehoboth on January 27, 2006, Mrs. Drown requests the minutes, any supporting documentation, the posting of the open meeting or emergency meeting where the decision was made to have the letter delivered and the order to send the police to her home.

Susan Shaw motioned that the members adopt a policy for attendance of legal counsel as it is written for the Board of Public Works and replace it with the Board of Health name which will go into effect immediately.
